Our commitment
Elite Training respects the intellectual property of others and expects everyone using the platform to do the same. We comply with the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. §512. This page explains how to report content that infringes your copyright, and how to file a counter-notice if your content was removed in error.
Filing a takedown notice (DMCA §512(c))
If you believe content hosted on Elite infringes your copyright, send a written notice to our designated DMCA agent (contact below). Your notice must include the following — if anything is missing, we can’t act on it:
- Your physical or electronic signature (typed name is fine).
- Identification of the copyrighted work you claim was infringed (or, if multiple works, a representative list).
- Identification of the material on Elite you claim is infringing, with enough detail for us to find it (the URL of the trainer profile, workout, clip, or comment is best).
- Your full name, mailing address, phone number, and email.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner.
On receipt of a valid notice, we will remove or disable access to the allegedly infringing material and notify the account holder who posted it. Repeat infringers’ accounts may be terminated.
Filing a counter-notice (DMCA §512(g))
If your content was removed and you believe the removal was a mistake or misidentification, you can submit a written counter-notice. It must include:
- Your physical or electronic signature.
- Identification of the content that was removed and the location where it appeared before removal.
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification.
- Your full name, mailing address, and phone number.
- A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the U.S., the U.S. District Court for any judicial district in which Elite may be found), and that you will accept service of process from the original complainant.
On receipt of a valid counter-notice we will forward it to the original complainant. Unless they file a court action within 10 business days, we will restore the removed content.
Bad-faith notices
17 U.S.C. §512(f) imposes liability for any person who knowingly materially misrepresents that content is infringing or was removed by mistake. Don’t file a DMCA notice unless you actually believe what you’re signing. We will pursue damages against bad-faith filers and cooperate with parties who do.
Repeat infringers
In line with §512(i), Elite maintains a policy of terminating, in appropriate circumstances, the accounts of users who are repeat copyright infringers. Three or more good-faith takedowns against a single account will trigger review by our trust & safety team and may result in permanent removal from the platform.
