The rules of using Elite.

1. About these terms

Welcome to Elite Training(“Elite,” “we,” “us”). These Terms of Service (“Terms”) govern your use of our website (elitetraining.app), mobile app, and related services (collectively, the “Service”).

By creating an account, downloading the app, or using the Service, you agree to these Terms and our Privacy Policy. If you don’t agree, don’t use the Service.

2. Who can use Elite

You must be at least 13 years old to create an account. If you are under 18, you represent that you have your parent or legal guardian’s permission to use the Service.

You may only have one account per person. You’re responsible for keeping your password secure and for all activity under your account.

3. What we provide

Elite is a basketball training platform connecting players with professional trainers (“Trainers”) for structured workout content, drill videos, skill ratings, and optional pay-per-session services like film breakdowns. Elite is a marketplace; we don’t personally coach or train you.

Trainers are independent contractors, not employees or agents of Elite. Elite is not responsible for the accuracy, quality, or safety of any Trainer’s instruction. You exercise at your own risk and should consult a physician before starting any new training program.

4. Subscriptions, billing, and auto-renewal

Elite offers paid subscription plans that unlock Trainer content. Current plans and pricing are listed at elitetraining.app/pricing. By subscribing, you authorize Elite (through Stripe, our payment processor) to charge your selected payment method on a recurring basis at the interval you chose (monthly or annual) until you cancel.

Subscriptions renew automatically at the end of each billing cycle. You will be notified by email before annual renewals. You can cancel anytime from Account Settings (web) or in the mobile app via “Manage Subscription on Web.” Cancellation takes effect immediately — you keep access to paid content until the end of the current billing period, after which you’ll be downgraded to the free tier.

Promotional pricing (e.g. AREYOUELITE for 20% off the first 2 months) applies only to the period stated and is non-stackable with other offers.

All payments are processed by Stripe. Elite does not store your card or bank account details. Your transactions are governed by Stripe’s terms.

5. Free trial

New players may receive a 7-day free trial of a single Trainer’s content, limited to 5 training sessions. The trial is provided as-is, has no monetary value, and is not transferable. After the trial ends, access locks unless you subscribe. Trial eligibility may be limited (e.g., one trial per Trainer per account).

6. Refunds

All purchases are final and non-refundable except where required by law. If you believe you were charged in error, contact us at support@elitetraining.app within 7 days of the charge and we’ll review on a case-by-case basis. We do not refund partial billing periods after cancellation.

7. Trainers — revenue share and payout terms

If you sign up as a Trainer, you grant Elite the right to list your content, accept payments on your behalf via Stripe Connect, and remit your share of subscription revenue to your connected bank account on Stripe’s standard schedule.

Revenue splits depend on your Trainer Tier, set by Elite based on your verified credentials and audience:

  • Marquee: Trainer keeps 85% / Elite 15%
  • Pro (default): Trainer 75% / Elite 25%
  • Established: Trainer 70% / Elite 30%
  • Development: Trainer 60% / Elite 40%
  • Youth: Trainer 50% / Elite 50%

For bundle plans (Triple, Elite Five), $10 of each subscription is attributed per Trainer slot; the Trainer’s tier percentage of that $10 is paid out as a Stripe Transfer each billing cycle. Margin above the slot totals accrues to Elite.

Payouts are made by Stripe. Elite reports trainer earnings to the IRS via Form 1099-NEC where required. You’re responsible for your own tax obligations.

Elite may, at its sole discretion and on reasonable notice, adjust tier assignments or revenue splits to reflect changes in your audience, performance, or platform economics. Active subscribers attributed to you remain at the rate in effect when they subscribed until renewal.

8. Content rights and ownership

Your content stays yours. Anything you upload (videos, photos, comments, ratings) remains your property. By uploading, you grant Elite a worldwide, non-exclusive, royalty-free license to host, display, transcode, distribute, and promote that content as part of the Service.

Trainer content. Trainers retain ownership of their workout videos and training materials. By uploading, they grant Elite the same license described above plus the right to make the content available to subscribed players.

Elite content. The Service itself — including the Elite name, logos, design, software, and any AI-generated features — is owned by Elite and protected by intellectual property law. You may not copy, modify, distribute, or reverse-engineer it without our written permission.

9. Acceptable use

You agree not to:

  • Use the Service for any illegal purpose.
  • Share your account credentials with anyone or attempt to access another user’s account.
  • Download, screen-record, or redistribute Trainer content outside the Service.
  • Upload content that is hateful, threatening, sexually explicit, defamatory, or infringes someone else’s rights.
  • Use bots, scrapers, or automated tools to access the Service.
  • Attempt to disrupt, overload, or circumvent the security of the Service.
  • Misrepresent yourself or your credentials when applying as a Trainer.

Violations may result in immediate suspension or termination of your account, forfeiture of any Trainer earnings owed, and potential legal action.

10. Termination

You can terminate your account at any time from Account Settings or by emailing support@elitetraining.app. On deletion, your account and personal data are removed within 30 days, your active subscriptions are cancelled, and you lose access to all paid content. Some data may be retained where required by law (e.g., tax records).

Elite may suspend or terminate your account if you violate these Terms, our policies, or applicable law. Where possible, we’ll give you notice and an opportunity to cure; severe violations may result in immediate termination.

11. Disclaimers

Physical activity carries risk. Basketball training is strenuous. You assume all risk of injury or illness from following any program on Elite. Consult a physician before starting any new exercise regimen, especially if you have a medical condition.

The Service is provided “as is” and “as available.” Elite makes no warranties about uptime, accuracy of ratings, suitability of training programs for any particular goal, or the qualifications of individual Trainers beyond the verification tier displayed on their profile.

12. Limitation of liability

To the maximum extent permitted by law, Elite’s total liability to you for any claim arising from or related to the Service is limited to the greater of (a) $100 or (b) the total amount you paid Elite in the 12 months preceding the claim.

Elite is not liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, goodwill, or data — even if we’ve been advised of the possibility.

13. Indemnification

You agree to defend, indemnify, and hold Elite, its officers, directors, employees, and Trainers harmless from any claim, damage, or expense (including reasonable attorney’s fees) arising from your violation of these Terms, your content, or your misuse of the Service.

14. Dispute resolution and arbitration

Informal resolution. Before filing any formal dispute, please email us at support@elitetraining.app so we can try to resolve it directly.

Arbitration. Any unresolved dispute between you and Elite (other than disputes about intellectual property) will be resolved by binding individual arbitration under the rules of the American Arbitration Association, seated in the State of Nevada, United States. You waive the right to participate in a class action.

Governing law. These Terms are governed by the laws of the State of Nevada, United States, excluding conflict-of-laws rules.

15. Changes to these terms

We may update these Terms from time to time. Material changes will be announced by email or in-app at least 7 days before they take effect. Continued use of the Service after a change means you accept the updated Terms.

16. Apple App Store additional terms

If you use the iOS app, you acknowledge that these Terms are between you and Elite — not between you and Apple. Apple has no obligation to provide support for the app. Apple is not responsible for any product warranties (express or implied) or for any claims relating to the app’s failure to conform to applicable legal requirements. Apple is a third-party beneficiary of these Terms and may enforce them against you.
